Terms and Conditions: KAF EFUNDS Website
These Terms and Conditions (T&C) govern your access to the KAF eFunds Platform ("KAF eFunds"). KAF eFunds offers two distinct digital access channels:
The Mobile Channel: Accessed via the KAF Digital Bank Mobile Application ("KAFDB App").
The Web Channel: Accessed directly via the KAF eFunds Web Platform ("Site").
This Site and the platform services are owned and managed by KAF Investment Funds Berhad (199501004999 (334195-K)) (“KIFB”).
1. Onboarding, Service Scope, and Data Sharing
1.1 Account Opening & Access Eligibility
To access and execute transactions on KAF eFunds, you must fulfil the criteria of either of the following access channels:
- Mobile Channel (KAFDB App Users): You must successfully open and maintain an active KAF Digital Bank Account before accessing and opening an investment account on KAF eFunds. KAF Digital Bank acts solely as the digital gateway and payment.
- Web Channel (Direct Web Users): You must be an existing customer of KAF Investment Funds Berhad (KIFB) with an account that has been previously verified and approved under KIFB's standard Know Your Customer (KYC) policies.
1.2 Service Provider
KAF eFunds is the investment platform provided by KIFB, the licensed fund manager. KAF Digital Bank does not manage the funds, provide investment advice, or guarantee investment returns.
1.3 Data Sharing & Cross-Platform Consent
By proceeding through the Mobile Channel, you consent to KAF Digital Bank securely sharing your necessary KYC data with KIFB to pre-fill, validate, and establish your KAF eFunds Account. By accessing via the Web Channel, you authorize KIFB to utilize your existing offline corporate record data to provision your digital web profile.
1.4 Risk Acknowledgement
All investments are subject to market risk. Past performance is not necessarily indicative of future performance, and the value of units can fluctuate.
2. Account Structure and Investment Channels
2.1 Initial Sub-Account (Direct Digital)
As a new digital platform customer, your initial fund purchase will automatically establish your first Investment Sub-Account, tagged as the Direct Digital Channel (Self-Managed).
3. Online Transactions and Processing
By submitting an application for an online investment, redemption, or switch, you agree to the following operational rules:
3.1 Transaction limits: You are allowed a maximum of five (5) transactions per day, which is a combined limit for both purchases and redemptions. You may only select one fund per purchase, redemption, or switch transaction.
3.2 Execution & Deduction: You understand that for purchases, the investment amount will be deducted from your Segregated Client Account at 11.00 AM Malaysia Time, provided there are sufficient funds to cover the purchase.
3.3 Payment Methods: Purchases must be processed exclusively via FPX.
3.4 Compliance & AML: All transactions are subject to daily Anti-Money Laundering (AML) risk screening. If your transaction yields a “High” risk score, it will be automatically placed on hold pending Due Diligence Approval by the Compliance team.
4. Forward Pricing and Cut-Off Times
4.1 Indicative Pricing: The Unit Price/Net Asset Value (NAV) displayed during the transaction request is purely indicative and for estimation purposes only. The final credited units may differ based on the actual processed NAV.
4.2 Cut-off Timing: Your application will be processed based on forward pricing prevailing at the time a complete request is received. If we receive your transaction request before the daily cut-off time (4:00 PM), your units will be priced based on the end of that Business Day’s NAV. Requests received after the cut-off time will be processed using the next Business Day’s NAV.
5. Investor Suitability Assessment Form (ISAF)
5.1 Validity: To ensure suitable recommendations, you must complete the ISAF. The resulting Risk Profile is valid for one (1) year.
5.2 Skipping the Assessment: You may choose to skip the ISAF questionnaire. If skipped, your risk profile and fund recommendations will automatically default to the “Conservative” category.
5.3 Higher Risk Consent: If you choose to transact in a fund that carries a higher risk than your established Risk Profile, you must explicitly acknowledge a “Purchase Consent, confirming you understand the investment risks involved and are voluntarily deciding to proceed against the recommendation.
6. Cooling-Off Right
6.1 Eligibility: If you are investing with KIFB for the first time, you have the right to request a cancellation of your investment within a six (6) Business Day cooling-off period.
6.2 Refunds: Refunds following a cooling-off request will be based on the NAV per unit on the day the units were first purchased, plus the Sales Charge per unit originally imposed.
7. Investment Purchases, Fees and Authorisation
7.1 Initial Sales Charge
For your initial purchases made through the Direct Digital Channel, you will be charged the platform's standard online sales charge rate.
7.2 Payment Security
To securely authorise all transactions (subscriptions, redemptions, transfers, switching and more).
- Web Channel Users: Transactions must be validated using a One-Time Password (OTP) that is automatically generated and sent to your registered email address.
8. Redemptions, Switching, and Statements
8.1 Redemption Source
You must specify the exact fund and sub-account channel from which any redemption or fund switch is to be executed. Redemption proceeds will only be disbursed into your verified, pre-registered personal bank account or linked KAF Digital Bank account. Third-party payments are strictly prohibited.
8.2 Statement Access
You may view and download all official statements (Statement of Account (SOA), Statement of Realisation (SOR), etc.) from KAF eFunds. These statements will clearly detail your holdings and transactions segmented by your distinct Investment Channels.
9. Support and Responsibility
9.1 Support Channel Segmentation
- Mobile App & Authorization Issues: KAF Digital Bank provides front-line support for mobile banking access and SecureKAF authorization issues.
- Fund & Portfolio Issues: All queries related to web platform access, email OTPs, fund performance, fees, statements, redemption status, and investment advice must be directed strictly to KIFB Customer Service via the official channels provided on the KAF eFunds platform.
10. Regulatory Compliance and Legal Declarations
10.1 Anti-Money Laundering (AMLATFAPUAA)
You certify that all funds deployed on this platform are derived from legitimate and lawful sources and are not connected to any unlawful activities under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.
10.2 Anti-Corruption (MACC Act)
You pledge adherence to the Malaysian Anti-Corruption Commission Act 2009, certifying that no gratification, bribes, or undue influence have been or will be offered in connection with your investments.
10.3 Tax Reporting (FATCA & CRS)
You consent to KIFB disclosing and reporting your transaction and profile details to regulatory or tax authorities to maintain compliance with the Foreign Account Tax Compliance Act and the Common Reporting Standard.
10.4 Personal Data Protection (PDPA)
In alignment with the Personal Data Protection Act 2010, you authorize KIFB to collect, process, use, and disclose your personal details and account data to related corporate entities, trustees, or regulatory bodies within or outside Malaysia for servicing, security evaluation, and direct marketing purposes as outlined in the KIFB Privacy Statement.
11. User Credentials, Security & Transaction Validation (OTP)
11.1 Confidentiality of credentials
You are entirely responsible for maintaining the strict confidentiality of your personalized login credentials, including user names, passwords, email access, and security verification answers. You assume full responsibility for all activities, instructions, and financial commitments occurring under your account resulting from carelessness, negligence, or a failure to maintain adequate personal device security.
11.2 Account Lock-out
Your account access requires a 6-digit OTP sent to your registered email. To prevent unauthorized access, exceeding three (3) failed OTP attempts will result in your account being temporarily locked.
