National Addressing Database Terms and Conditions


“BEFORE YOU CLICK ON THE “I AGREE” BUTTON, PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY. BY CLICKING ON THE “I AGREE” BUTTON, YOU SIGNIFY YOUR AGREEMENT TO THESE TERMS AND CONDITIONS AND YOU SHALL BE BOUND BY THE SAME.”

1.    Overview

1.1    In this National Addressing Database (“NAD”) Terms and Conditions (“Terms and Conditions”), references to “You”, ”Your” and  “Yours” refers  to  the  customers who are utilising the NAD service and has an account with KAF Digital Bank Berhad (Company No. 202301012417 (1506339-M)) and references to “We”, “Our”, “Ours” and “Us” refer to KAF Digital Bank Berhad.

2.    Definitions & Interpretations

2.1    The following terms and expressions shall apply to this Terms and Conditions, unless the context requires otherwise:

“Banking Services”

means the facilities, products and services of KAF Digital Bank Berhad that are made available to You that can be accessed through the Mobile Application. 

 

“BNM”

refers to Bank Negara Malaysia, the Central Bank of Malaysia. 

 

"Business Day"

Any day from Monday to Friday on which the Bank is open for business in Malaysia but does not include any public holiday.

 

“Bank’s Contact Centre”

means the details of the Bank as follows:

“Islamic Deposit Account”

means the Shariah-compliant Savings Account-i (SA-i) offering Malaysian Ringgit to the Customer subject to the Bank’s Islamic Deposit Account Terms and Conditions.

 

“Debit Card-i”

 

means any Debit Card-i issued by the Bank to the Customer providing electronic access to the Customer’s Islamic Deposit Account, and to allow the Customer to effect any transactions subject to the Bank's Debit Card-i Terms and Conditions.

 

“Mobile Application”

 

means an account governing Mobile Application that is linked to the Islamic Deposit Account, Debit Card-i and all other services and products offered by the Bank from time to time.

 

“DuitNow Transfer”

means an overlay service of Retail Payment Platform (as defined below) which allows You to initiate and receive credit transfer.

 

“DuitNow ID” 

means an identifier of an account holder such as a mobile number, NRIC, passport number, army number or police number (in the case of an individual) or business registration number (in the case of a corporate customer) or any other identifiers as may be introduced by the DuitNow Operator from time to time. 

 

“DuitNow Operator” 

means Payments Network Malaysia Sdn. Bhd. (Company No.: 200801035403 [836743-D]).

 

“Look-up Request”

Refers to request(s) made by You in order to access the DuitNow service through the Mobile Application. 

 

“NAD”

means the National Addressing Database which is a central depository established by PayNet which links a bank account to a recipient’s DuitNow ID and facilitates payment to be made Us by referring to Your DuitNow ID.

 

“NAD Name Enquiry”

means a service which returns the name of the owner who has registered its DuitNow ID in NAD.

 

“NAD Operator”

means Payments Network Malaysia Sdn. Bhd. (PayNet) (Company No.: 200801035403 [836743-D])

 

“PayNet”                         

refers to Payments Network Malaysia Sdn. Bhd.

 

 

“Pay-to-Account”

refers to the account which funds will be transferred.

 

“Pay-to-Proxy”

refers to a mechanism which allows companies to send funds to individuals and other businesses on a real-time basis, without the need for naming a beneficiary bank or any details of the account. 

 

“Personal Data” 

means any information in respect of commercial transactions that relate directly or indirectly to You, who are identified or identifiable from that information which includes, but not limited to, the your name, address, identification card number, passport number, banking information, email address and contact details.

 

“Common ID”

means a unique identification of a customer which links all DuitNow IDs register by the customer such as the customer’s NRIC, army/police personal number, or or non-Malaysian, passport number.

 

“Retail Payment Platform” 

means the shared payment infrastructure developed and operated by PayNet which facilitates payments and collections addressed using easily remembered proxies or by account numbers.

 

“Shariah”

refers to Shariah principles as determined from time to time by the rulings of the Shariah Advisory Council of BNM and the Shariah Committee. You and KAF Digital Bank Bhd agree that their respective rights and obligations herein are intended to be and in conformity with the Shariah as determined from time to time by the rulings of Shariah Advisory Council of BNM and the Shariah Committee.

 

“Shariah Committee”

refers to the Shariah committee of the Bank. 

 

“Malware”

means computer viruses, bugs or other malicious, destructive or corrupting software, code, agent, program or macros, and/or phishing or social engineering schemes which utilise computer software or telecommunications to obtain personal data or any other personal information for malicious or fraudulent purposes.

2.2    In the event of any conflict in the interpretation and translation of this Terms and Conditions in any language, the English version of this Terms and Conditions shall prevail.

3.    Introduction

3.1    This Terms and Conditions apply and regulate Your use of the DuitNow service made available by Us. The DuitNow service allows You to transfer an amount specified by You from Your designated bank account maintained with Us, to a bank account maintained by Your recipient at a participating DuitNow participant via Pay-to-Account number and Pay-to-Proxy (Pay via DuitNow ID), or such other means as prescribed by Us or the NAD Operator from time to time.

3.2    The DuitNow services made available by Us is part of the services under KAF Digital Bank Bhd, and accordingly, this Terms and Conditions are in addition to and shall be read in conjunction with KAF Digital Bank Bhd’s Mobile Application Terms and Conditions. Any use of the DuitNow services and acceptance of this Terms and Conditions by any other person(s) or user(s) authorised by You for the purposes of the Mobile Application shall be deemed as Your use of the Mobile Application and Your acceptance of this Terms and Conditions.

4.    The NAD Service

4.1    The NAD service allows You to link an Account that You have with Us to Your DuitNow ID.

4.2    By linking Your DuitNow ID to Your Account, You have the option of receiving incoming funds via DuitNow or any other payment services that address payments using Your DuitNow ID.

4.3    When You register Your DuitNow ID in NAD, You will also provide Us with Your Common ID which will be linked to Your Account with Your registered DuitNow ID. Your Common ID will be used by other NAD participating banks for the urpose of identifying You, as part of facilitating the DuitNow service.

4.4    You may link more than one of Your DuitNow ID to the same Account. However, You may not link a particular DuitNow ID to multiple Accounts.

5.    Modification and Deregistration of your DuitNow ID

5.1    You may update or change Your DuitNow ID that is linked to Your Account via the channels made available to You. We will require a reasonable notice period to effect such changes or update.

5.2    You understand and agree that Your DuitNow ID that is linked to Your Account may be deregistered by You or by Us, due to the following circumstances:

(a)    You wish to transfer Your existing DuitNow ID to another Account in another bank;

(b)    You have changed/updated Your DuitNow ID;

(c)    You have closed Your Account that is linked to Your DuitNow ID;

(d)    the mobile number which You have provided to Us as Your DuitNow ID has been terminated and recycled for use by another person;

(e)    after a period of inactivity; or

(f)    upon investigation, We find out that You or Your DuitNow ID is potentially involved in any fraudulent activity(s).

5.3    You will receive a confirmation of de-registration from Us as soon as the de-registration is confirmed.

6.    Your Information

6.1    You represent and warrant that the DuitNow ID used for registration in NAD belongs to You, is correct, complete and up-to date for the use of the service and You will promptly notify Us if there is any change to the DuitNow ID information provided to Us.

6.2    You acknowledge and agree that other NAD participating banks issuers may perform a NAD Name Enquiry of Your DuitNow ID for the purpose of verifying/identifying Your name to Your registered DuitNow ID, as part of facilitating the DuitNow service.

6.3    You acknowledge and consent to the disclosure of Your DuitNow ID, Your Common ID and other relevant Personal Data to the NAD Operator for its processing, storing, and archival and disclosure to the sender of funds or merchants under the DuitNow services, Our affiliates, service providers, other NAD participants and third parties offering the DuitNow service and their respective customers.

6.4    You acknowledge and agree that We may disclose your DuitNow ID information to anyone who We are under obligation to disclose information to under the law or where it’s in the public interest, for example to prevent or detect fraud and abuse.

7.    Data Protection

7.1    Your consent and Our right to disclose information shall be in addition to, and without prejudice to the rights accorded to You under the Personal Data Protection Act 2010 and any other applicable laws in Malaysia.

7.2    We will only disclose, use and process Your DuitNow ID for the purpose of facilitating the DuitNow service.

7.3    We have in place reasonable security measures (both technical and organisational) against unlawful or unauthorised processing of Your DuitNow ID.

7.4    We will notify You as soon as practicable if Your DuitNow ID is lost, destroyed, or becomes damaged, corrupted or unusable.

8.    Liability

8.1    We and the NAD Operator shall not be liable for any losses or damage You may suffer as a result of, including but without limitation:

(a)    Your failure to maintain up-to-date information and /or Your failure to provide accurate information to us;

(b)    Our compliance with any instruction given or purported to be given by You which is apparent to a reasonable person receiving such instruction;

(c)    any misuse or any purported or fraudulent use of Your DuitNow ID including instances whereby online fraud is perpetrated by way of any Malware;

(d)    any disclosure of any information which You have consented to Us collecting, using or disclosing or where such collection, Use or disclosure is permitted or required to be disclosed under the applicable laws in Malaysia.

9.    Miscellaneous

9.1    You acknowledge that We have the right to change, vary or modify these Terms by providing You with thirty (30) days’ notice in such manner as We deem fit and You agree to be bound by such Terms as cancelled, revised or modified.

9.2    These Terms shall be construed in accordance with the laws of Malaysia and You agree to submit to the non-exclusive jurisdiction of the courts of Malaysia.

10.    General

10.1    Subject to Shariah, we reserve the right to revise at any time, such charges for the use of the DuitNow services, by providing You with thirty (30) days written notice through the Mobile Application. Such revisions shall take effect from the date stated in the notice. It shall be Your responsibility to be informed of or otherwise seek out any such notice validly posted. Where you continue to access or use the DuitNow services after such notification, You shall be deemed to have agreed to and accepted such revisions to such charges.

10.2    You acknowledge that We may terminate Your use of the DuitNow services with Us for any reason, at any time and without prior notice.

10.3    Subject to Shariah, You acknowledge that We have the right to amend, change, restrict, vary, suspend or modify this Terms and Conditions by providing You with thirty (30) days’ notice through the Mobile Application.  

10.4    You consent to the collection, use and disclosure of the Personal Data by Us, Our affiliates, Our service providers and the NAD Operator as required for the purposes of the DuitNow services.

10.5    This Terms and Conditions are governed by and shall be construed in accordance with the laws of Malaysia and you agree to submit to the exclusive jurisdiction of the courts of Malaysia.

10.6    If any of the provision in this Terms and Conditions is deemed to be illegal, invalid or unenforceable for any reason, whether in whole or in part, the remaining provisions of this Terms and Conditions are unaffected by the illegality, invalidity or unenforceability, and shall remain in full force and effect to the maximum extent permitted by law.

11.    Perbadanan Insurans Deposit Malaysia (PIDM)

11.1    The deposits maintained by the Customer in the Islamic Deposit Account are eligible for protection by Perbadanan Insurans Deposit Malaysia (PIDM) or Malaysia Deposit Insurance Corporation. Coverage of the eligible Islamic Deposit Account balance is subject to this Terms and Conditions as set by PIDM. A copy of the PIDM brochure has been provided to the Customer.

11.2    Subject to the latest version of guidelines by PIDM and any amendment(s) thereof, any deposit will be protected by PIDM up to RM 250,000 for each depositor.
